คำให้การของพยานนายกิตติชัย แข็งขันในเหตุการ์สังหารหมู่วัดปทุมฯ ปี 2553

เอกสารนี้คือบันทึกคำให้การของพยานนายกิตติชัย แข็งขันอย่างเป็นทางการของกรมสอบสวนคดีพิเศษ พยานได้รับการว่าจ้างจากสำนักงานตำรวจแห่งชาติซึ่งตั้งอยู่บนถนนพระรามที่ 1และอยู่ตรงข้ามวัดปทุมฯ กิตติชัยไม่ได้เพียงแค่เห็นกองทัพไทยยิงประชาชนที่วัดปทุมฯ เท่านั้น แต่เขายังถูกหทารยิงถึงสองครั้งด้วยกัน เอกสารฉบับนี้ลงวันที่ 20 ตุลาคม พ.ศ. 2553  และลงนามโดยบุคคลสองคน ได้แก่พนักงานอัยการภานุพงษ์ โชติสิน และพนักงานสอบสวนดีเอสไอ พ.ต.ท.ธรณินทร์ คลังทอง บันทึกคำให้การยังรวมถึงภาพถ่ายของสถานที่เกิดเหตุด้วย กิตติชัยคือพยานคนสำคัญและเป็นผู้พูดจาอย่างเปิดเผยเกี่ยวกับเหตุการณ์สังหารหมู่ที่วัดปทุมฯ ในวันที่ 1 ตุลาคม พ.ศ. 2555 เขาเสียชีวิตลงอย่างกระทันหันและปราศจากคำอธิบายถึงสาเหตุการเสียชีวิตอย่างแท้จริง

ในบันทึกคำให้การ กิตติชัยกล่าวว่าเขาได้รับการว่าจ้างจากสำนักงานตำรวจแห่งชาติเป็นเวลาสองอาทิตย์เพื่อให้มาเดินสายไฟ ในเที่ยงวันของวันที่ 19 พฤษภาคม พ.ศ. 2553 เขาเดินทางไปพบเพื่อนของเขาซึ่งเป็นผู้ชุมนุมนปช.จากขอนแก่นและอาศัยอยู่ในวัดปทุมฯ ในเวลา 18 นาฬิกาของวันที่ 19 พฤษภาคม พ.ศ. 2553 ระหว่างที่เขายืนอยู่หน้าวัดปทุมฯ เขาได้ยินเสียงปืนหลายครั้งดังมาจากรถไฟฟ้าบีทีเอส เขาจึงวิ่งเข้าไปในวัดและหลบอยู่ใต้ท้องรถยนตร์

เมื่อกิตติชัยถูกยิงที่หลังระหว่างที่หลบอยู่ใต้ท้องรถ เขาได้โบกมือออกมาจากใต้ท้องรถแต่กลับถูกยิงที่มืออีกครั้ง หลังจากนั้นเขาได้ยินเสียงตะโกนว่า “ออกมาจากใต้ท้องรถ ถ้าไม่ออกมาจะยิงให้ตายหมด”

เมื่อเขาคลานออกมาจากใต้ท้องรถ กิตติชัยเห็นทหารสองนายถือปืนยาวเล็งมาที่เขาอย่างชัดเจน เขากล่าวเพิ่มว่าทหารอยู่ห่างจากเขาเพียงแค่ 30-50 เมตร และในขณะนั้นยังมีแสงสว่างอยู่

กิตติชัยกล่าวว่าไม่มีผู้ชุมนุมคนใดในวัดปทุมฯ มีอาวุธ
 
This document is the transcript of an official Department of Special Investigation (DSI) witness statement as provided by Kittichai Kaengkan, a contractor employed at the Royal Thai Police’s HQ on Rama 1 Road, just opposite the Wat Pathum temple. Kittichai not only witnessed the Thai Army shooting at Wat Patum but was also shot twice himself. The document is dated October 20, 2010 and is signed by Kittichai and two other persons - the prosecutor, Panuphong Chotisin and DSI investigator, Police Lieutenant-Colonel Torranin Klangtong. As well as the transcript the document also includes a number of photographs at the crime scene. Kittichai was an outspoken and key witness regarding the killings at Wat Prathum. He died, suddenly and without real explanation, on October 1st 2012.

In his statement Kittichai says he was contracted by Police HQ to work for two weeks on the electricity system. At noon on May 19, 2010 he went to see his friends from Khon Kaen who were UDD protesters staying at Wat Pathum. At 18.00 May 19 2010 he was in front of the temple when he heard many gunshots coming from the BTS so he ran back into the temple and hid under a car.

Whilst Kittichai was under the car he was shot in the back, so he waved both hands but was shot again, this time being shot through his hand. He then heard shouting “get away from the car, otherwise I will shoot you all dead!”

When he crawled out from under the car, Kittichai clearly saw two armed soldiers on the BTS rail pointing rifles at him - he added those soldiers were only 30-50 metres away from him and there was still daylight.

Kittichai stated none of the protesters in the temple were armed.

After Kittichai was shot in the back and the hand he was ordered to stand by the soldiers and remove his shirt.
