นี่คือคำให้การในฐานะพยานของพ.ต.ท.ไวพจน์ อาภรรัตน์กรณีการสลายการชุมนุมของทหารในวันที่ 19 พฤษภาคม พ.ศ. 2553 ลงวันที่ 7 ธันวาคม พ.ศ. 2554 คำให้การที่สำคัญคือมีการใช้กำลังเกินกว่าเหตุต่อผู้ชุมนุมในปี 2553 ในเอกสาร เราขีดทับข้อมูลส่วนตัวของพ.ต.ท.ไวพจน์ อาภรรัตน์

พ.ต.ท.ไวพจน์ อาภรรัตน์ถูกตัดสิทธิ์ทางการเมืองเป็นเวลา 5 ปี [ในปลายปี 2551] เนื่องจากเป็นกรรมการบริหารพรรคพลังประชาชน (พปช.)

เขากล่าวว่าเขาเป็นผู้สนับสนุนนปช.และเข้าร่วมชุมนุม
เขากล่าวว่าเมื่อรัฐบาลสลายการชุมนุมนปช.ปี 2552 ผู้ชุมนุมได้ปิดแยกสามเหลี่ยมดินแดงและพบอาวุธสงครามจำนวนมากให้รถบรรทุของทหาร อย่างไรก็ตาม ทุกครั้งที่พวกเขาพบอาวุธ พวกเขาก็จะส่งคืนให้ทางตำรวจ แสดงให้เห็นว่านปช. ชุมนุมอย่างสงบ มิได้มิเจตจำนงค์ที่จะใช้อาวุธเหล่านั้นต่อสู้กับทหาร

เมื่อถูกถามว่าเขาคิดว่าการสลายการชุมนุมของทหารนั้นถูกต้องตามหลักสากลหรือไม่ พ.ต.ท.ไวพจน์ อาภรรัตน์กล่าวว่าไม่ เพราะไม่มีการเจรจา และแม้การเจรจาล้มเหลว รัฐบาลจะต้องออกประกาศเตือน และใช้กระบอง รถน้ำ หรือกระสุนยางเพื่อสลายการชุมนุมหลังจากนั้น และจะต้องไม่มีการใช้กระสุน “จริง” อย่างเด็ดขาด แต่ในะระหว่างการสลายการชุมนุมในวันที่ 19 พฤษภาคมมีการใช้กระสุนจริง และเอกสารของศอฉ.ยังยืนยันโดยระบุว่าในระหว่างการสลายการชุมนุมในเดือนเมษายน/พฤษภาคม ทหารใช้กระสุนจริง 120,000 นัด และกระสุนซุ่มยิง 2,600 นัด ซึ่งทำให้มีผู้เสียชีวิต 93 รายและบาดเจ็บ 2,000 ราย




Witness Statement of Police Lt-Col Wipot Apornrat Regarding Deaths at Wat Patum, May 2010

This is the witness statement of Police Lieutenant-Colonel Wipot Apornrat regarding the army crackdown on May 19, 2010. It is dated December 7, 2011. The central allegation is that disproportionate force was used against the protest in 2010. Personal details of Lt. Col. Wipot have been redacted by ourselves.

Lt-Col Wipot Apornrat was banned from political activities for five years [in late 2008] as he was an executive member of the People's Power Party (PPP).

He stated he was a UDD supporter and had also joined the protest.

He stated that when the government cracked down on the [previous] 2009 UDD protest, the protesters had blocked Din Daeng intersection and found many war weapons inside army trucks. However, every time they found such weapons3 they would return them to the police. This showed that the UDD protested peacefully - because even though they had seized weapons from the army, they had no intention of using them against the army.

In 2010, the UDD protesters returned and demanded that the government dissolve the parliament and hold a general election - this protest was also peaceful.

When asked whether he thought that the army’s crackdown was consistent with international standards or not Lt-Col Wipot Apornrat stated that it was not because there was no negotiation and even if those negotiations failed, the govt must then issue the warning, then use batons, water canon and/or rubber bullets to disperse the protesters - there must strictly be no use of “live” rounds. But during the crackdown on May 19th live round bullets were used. This is backed up by CRES’s own document which indicates that during the April/May 2010 crackdown, the army used 120,000 live round bullets and 2,600 sniper bullets which resulted in 93 deaths and 2,000 injuries.

คำสั่งศาลกรณีสาเหตุการเสียชีวิตของด.ช.คุณากร ศรีสุวรรณ (อายุ 14 ปี)

การเสียชีวิตของด.ช.คุณากรทำให้ผู้นำพรรคประชาธิปัตย์นายอภิสิทธิ์ เวชชาชีวะและนายสุเทพ เทือกสุบรรณถูกแจ้งข้อหาฆ่าคนตายโดยเจตนา อย่างไรก็ตาม แม้ว่าโดยเริ่มแรกคดีดังกล่าวจะถูกไต่สวนในศาลอาญา แต่กลับถูกส่งให้คณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติพิจารณาหลังการทำรัฐประหารปี 2557 นี่คือการปฏิเสธความยุติธรรมตามธรรมชาติอย่างชัดแจ้งและไม่สามารถอธิบายได้

นักข่าวซึ่งเป็นพยานในเหตุการณ์กล่าวว่าในวันที่ 14 พฤษภาคม พ.ศ. 2553 เวลาราว 23 นาฬิกา ได้พบเห็นด.ช.คุณากรวิ่งเล่นบริเวณบังเกอร์ทหารใต้สถานีรถไฟแอร์พอร์ตลิงค์แยกมักกะสัน [ถนนราชปรารภ]
หลังนั้นประมาณเที่ยงคืน นายสมร ไหมทองขับรถตู้บนถนนถนนราชปรารภมุ่งหน้าไปยังมักกะสันซึ่งเป็นพื้นที่ควบคุมโดยทหาร ทหารใช้โทรโข่งสั่งให้นายสมรขับรถออกไปจากพื้นที่แต่เขามิได้ทำเช่นนั้น ทหารจึงระดมยิงไปที่รถตู้หลายครั้ง นายสมรถูกยิงได้รับบาดเจ็บ และประชาชนอีก 2 รายคือนายพัน คำกองและด.ช.คุณากร ศรีสุวรรณ ถูกยิงเสียชีวิต
กระสุนในร่างของด.ช.คุณากร ศรีสุวรรณซึ่งเป็นสาเหตุของการเสียชีวิตเป็นกระสุนความเร็วสูงที่ใช้ในอาวุธสงครามอย่างปืนเอ็ม 16 และอาก้า ศาลตรวจสอบหลักฐานและสรุปว่ากลุ่มคนที่มีอาวุธปืนเอ็ม 16 หรืออาวุธใช้กับกระสุนความเร็วสูงอื่นในบริเวณนั้นมีเพียงทหารเท่านั้น ดังนั้น ศาลจึงสรุปว่าการเสียชีวิตของด.ช.คุณากร ศรีสุวรรณเกิดจากกระสุนความเร็วสูงยิงมาจากทหาร

Court Ruling Into The Cause Of Death Of Kunakorn Srisuwan (aged 14)

The death of Kunakorn resulted in the prosecution for murder of Democrat Party's Abhisit Vejjajiva and Suthep Thuagsuban. However, despite the case initially being heard in the Criminal Court, since the 2014 military coup it has been moved to the National Anti Corruption Commission. This is inexplicable and a clear denial of natural justice.

A précis of the court document follows.
 

Kunakorn was a 14year old orphan who resided at the International Islamic Relief Organisation orphanage on Ramkanhaeng Road. 

A journalist who witnessed events  stated that on May 14, 2010 around 11pm they saw Kunakorn running around and playing near the army’s barricade under the airport link train station at Makkasan Junction [Ratchaprarop Rd].

Then, around midnight, Mr. Samorn Maithong drove his van on Ratchaprarop road heading towards Makkasan, an area that was controlled by the army. The authorities used a megaphone to order Mr. Samorn to drive his van out of the area but he failed to do so. The soldiers then opened fire on the van, firing many times and Mr. Samorn was shot and injured and two other people, Mr. Phan Kamklong and Kunakorn Srisuwan were shot and killed 


The bullet found in Kunakorn Srisuwan that killed him was a high velocity bullet of the type used by war weapons such as an M16 or AK47.  The court examined the evidence and concluded the only persons with M16s or other high velocity war weapons in that area were Thai Army soldiers. Therefore the court ruled that Kunakorn Srisuwan’s death was caused by a bullet fired by the Thai Army soldiers.

2010 Wat Pathum Killings Witness Statement of Kittichai Kaengkan

คำให้การของพยานนายกิตติชัย แข็งขันในเหตุการ์สังหารหมู่วัดปทุมฯ ปี 2553

เอกสารนี้คือบันทึกคำให้การของพยานนายกิตติชัย แข็งขันอย่างเป็นทางการของกรมสอบสวนคดีพิเศษ พยานได้รับการว่าจ้างจากสำนักงานตำรวจแห่งชาติซึ่งตั้งอยู่บนถนนพระรามที่ 1และอยู่ตรงข้ามวัดปทุมฯ กิตติชัยไม่ได้เพียงแค่เห็นกองทัพไทยยิงประชาชนที่วัดปทุมฯ เท่านั้น แต่เขายังถูกหทารยิงถึงสองครั้งด้วยกัน เอกสารฉบับนี้ลงวันที่ 20 ตุลาคม พ.ศ. 2553  และลงนามโดยบุคคลสองคน ได้แก่พนักงานอัยการภานุพงษ์ โชติสิน และพนักงานสอบสวนดีเอสไอ พ.ต.ท.ธรณินทร์ คลังทอง บันทึกคำให้การยังรวมถึงภาพถ่ายของสถานที่เกิดเหตุด้วย กิตติชัยคือพยานคนสำคัญและเป็นผู้พูดจาอย่างเปิดเผยเกี่ยวกับเหตุการณ์สังหารหมู่ที่วัดปทุมฯ ในวันที่ 1 ตุลาคม พ.ศ. 2555 เขาเสียชีวิตลงอย่างกระทันหันและปราศจากคำอธิบายถึงสาเหตุการเสียชีวิตอย่างแท้จริง

ในบันทึกคำให้การ กิตติชัยกล่าวว่าเขาได้รับการว่าจ้างจากสำนักงานตำรวจแห่งชาติเป็นเวลาสองอาทิตย์เพื่อให้มาเดินสายไฟ ในเที่ยงวันของวันที่ 19 พฤษภาคม พ.ศ. 2553 เขาเดินทางไปพบเพื่อนของเขาซึ่งเป็นผู้ชุมนุมนปช.จากขอนแก่นและอาศัยอยู่ในวัดปทุมฯ ในเวลา 18 นาฬิกาของวันที่ 19 พฤษภาคม พ.ศ. 2553 ระหว่างที่เขายืนอยู่หน้าวัดปทุมฯ เขาได้ยินเสียงปืนหลายครั้งดังมาจากรถไฟฟ้าบีทีเอส เขาจึงวิ่งเข้าไปในวัดและหลบอยู่ใต้ท้องรถยนตร์

เมื่อกิตติชัยถูกยิงที่หลังระหว่างที่หลบอยู่ใต้ท้องรถ เขาได้โบกมือออกมาจากใต้ท้องรถแต่กลับถูกยิงที่มืออีกครั้ง หลังจากนั้นเขาได้ยินเสียงตะโกนว่า “ออกมาจากใต้ท้องรถ ถ้าไม่ออกมาจะยิงให้ตายหมด”

เมื่อเขาคลานออกมาจากใต้ท้องรถ กิตติชัยเห็นทหารสองนายถือปืนยาวเล็งมาที่เขาอย่างชัดเจน เขากล่าวเพิ่มว่าทหารอยู่ห่างจากเขาเพียงแค่ 30-50 เมตร และในขณะนั้นยังมีแสงสว่างอยู่

กิตติชัยกล่าวว่าไม่มีผู้ชุมนุมคนใดในวัดปทุมฯ มีอาวุธ
 

This document is the transcript of an official Department of Special Investigation (DSI) witness statement as provided by Kittichai Kaengkan, a contractor employed at the Royal Thai Police’s HQ on Rama 1 Road, just opposite the Wat Pathum temple. Kittichai not only witnessed the Thai Army shooting at Wat Patum but was also shot twice himself. The document is dated October 20, 2010 and is signed by Kittichai and two other persons - the prosecutor, Panuphong Chotisin and DSI investigator, Police Lieutenant-Colonel Torranin Klangtong. As well as the transcript the document also includes a number of photographs at the crime scene. Kittichai was an outspoken and key witness regarding the killings at Wat Prathum. He died, suddenly and without real explanation, on October 1st 2012.

In his statement Kittichai says he was contracted by Police HQ to work for two weeks on the electricity system. At noon on May 19, 2010 he went to see his friends from Khon Kaen who were UDD protesters staying at Wat Pathum. At 18.00 May 19 2010 he was in front of the temple when he heard many gunshots coming from the BTS so he ran back into the temple and hid under a car.

Whilst Kittichai was under the car he was shot in the back, so he waved both hands but was shot again, this time being shot through his hand. He then heard shouting “get away from the car, otherwise I will shoot you all dead!”

When he crawled out from under the car, Kittichai clearly saw two armed soldiers on the BTS rail pointing rifles at him - he added those soldiers were only 30-50 metres away from him and there was still daylight.

Kittichai stated none of the protesters in the temple were armed.

Thai Army Small Arms Munitions Use During Bangkok Massacre 2010

This is the latest document release for the Thai Accountability Project. We believe some or all of this document has been released before. However we wish to place its full contents in the public domain for archiving purposes.

Here is the official count of small-arms munitions as supplied by the Thai Army for its use during the Prime Minister Abhisit-sanctioned Centre for the Resolution of the Emergency Situation (CRES) operations during the April/May 2010 Bangkok Massacre.

It’s signed off by the SP5 munitions unit of the Thai Army, on 20 December 2010.

In total 597,500 small-arms munitions were issued in the form of 00 shotgun cartridges, standard 5.56mm x 45mm cartridges as used by M16 family of assault rifles, 3000 7.62mm X 51mm shells for SSG3000 sniper rifles.

The list then counts that just over 522,000 cartridges and shells were returned meaning that almost 77,000 shells and cartridges were fired by the Thai Army during the CRES operations.

The most shocking detail is that only 880 7.62mm X 51mm shells for the SSG3000 sniper rifle were returned after the CRES operation. This means that 2120 sniper rounds of the 3000 issued were almost certainly fired by the Thai Army at the Red Shirt protesters in April/May 2010.

Centre for the Resolution of the Emergency Situation (CRES) order, April 17, 2010

ทั้งยังมีการระบุกฎการใช้กำลังว่า

“ให้มีการยิงเตือนหากผู้ต้องสงสัยไม่ยอมให้ทำการตรวจค้น/จับกุม และกำลังะหลบหนี และเจ้าหน้าที่สามารถใช้อาวุธ “ป้องกันตัวโดยชอบด้วยกฎหมาย” และไม่เกินกว่าเหตุได้ และหาก “ผู้ก่อเหตุซึ่งมีอาวุธใช้อาวุธต่อเจ้าหน้าที่” เจ้าหน้าจึงสามารถใช้อาวุธตอบโต้ได้ อย่างไรก็ตามหาก “ผู้กาอเหตุ” ปะปนอยู่ใน “ฝูงชน” เจ้าหน้ามิควรยิงข้าไปใน “ฝูงชน” เพราะอาจ “ทำอันตราย” ต่อประชาชนผู้บริสุทธิ์ ดังนั้นควรใช้ “พลแม่นปืน” แทน และหากยากต่อการจัดการกับ “ผู้ก่อเหตุ” เจ้าหน้าที่สามรถร้องขอใช้ “พลซุ่มยิง” จากศอฉ. ได้


Here is the latest document release in our ongoing Thailand Accountability Project (TAP). Some of these documents may already be in the public domain others may not. However, we view the role of TAP as archiving documents in the public domain for the Thai public to access.

This is the Centre for the Resolution of the Emergency Situation (CRES) order produced on April 17, 2010 and signed by Lt.Gen.Aksara Kerdphon.

The document claims there are armed terrorists among the Red Shirt protesters and allows the use of marksmen and snipers.

It also specifies the rules of engagement as being
 

 “Warning shots are allowed if the suspect refuses to be searched/arrested and is about to run away” and weapons can be used in a proportionate fashion “for lawful self-defence”. Also if an “armed perpetrator” is seen “using weapons against the authorities” then it’s permissible to use weapons against them. However if the “perpetrator” is in “a crowd” they should not shoot into the “crowd” as this could “harm” innocent people and therefore should use “marksmen” instead. If the “perpetrator” is harder to target they can also request a “sniper” to be used.

บันทึกการเจรจาระหว่างสมาชิกวุฒิสภากับแกนนำนปช. วันที่ 18 พฤษภาคม พ.ศ. 2553

วันที่ 18 พฤษภาคม พ.ศ. 2553 ในชั่วโมงสุดท้ายของการชุมนุมเรียกร้องประชาธิปไตยในกรุงเทพฯ แกนนำผู้ชุมนุมร่วมประชุมกับสมาชิกวุฒิสภาหลายคนในความพยายามครั้งสุดท้ายเพื่อเจรจาหาทางออกที่สันติ

รายละเอียดของการเจรจามักถูกโต้แย้งอย่างรุนแรงอยู่เสมอ ในตอนหลังรัฐบาลนายอภิสิทธิ์อ้างว่าเสื้อแดง/นปช.ตกลงจะ “หยุดยิงทหาร” เท่านั้น คำกล่าวนี้บอกเป็นนัยว่าแกนนำผู้ชุมนุมปฏิเสธที่จะตกลงเจรจาอย่างสันติโดยปราศจากเงื่อนไข

วันนี้ เราขอเผยแพร่บันทึกในวันที่ 18 พฤษภาคม พ.ศ. 2553 ในบันทึกระบุว่าการเจรจาระหว่างเสื้อแดง/นปช. และสมาชิกวุฒิสภาเกิดขึ้นเวลา 18.30น. -20.15น. เอกสารฉบับนี้เผยให้เห็นว่าเสื้อแดง/นปช. เห็นด้วยกับการเจรจาแบบไม่มีเงื่อนไขกับรัฐบาลนายอภิสิทธิ์ และนอกจากนี้สมาชิกวุฒิสภายังได้รับคำสัญญาจากรัฐบาลนายอภิสิทธิ์ว่า หากแกนนำเสื้อแดง/นปช.เข้าร่วมการพูดคุยอย่างไม่มีเงื่อนไข นายอภิสิทธิ์จะยับยั้งการใช้ทหารเข้าปราบปรามในอนาคต

Memo Of Senate Negotiations With UDD Leadership May 18th 2010

On May 18th 2010, in the final hours of the Red Shirt/UDD pro-democracy protest in Bangkok, the protest leaders met with several members of the Thai senate in a last attempt to negotiate a peaceful resolution.

The contents of that negotiation has always been deeply contested - the Abhisit government later claimed that the Red Shirts/UDD had stated that they would only “stop shooting at the Army”, a statement that clearly implies that the protest leaders refused to agree to unconditional peace talks.

Today we publish a memo dated 18th May 2010 - it even specifies a time frame of 630pm-815pm - which amounts to the only record of the Red Shirt/UDD and senator negotiations. This document reveals that the Red Shirts/UDD did agree to an unconditional negotiation with the Abhisit regime and, furthermore, that the senators had a form of commitment from the Abhisit regime that if the Red Shirts/UDD leadership did participate in unconditional talks, then Abhisit would suspend any further military crackdown.

What lends substantive weight to this memo is that it has been signed and certified by both a police Colonel and what we assume to be a DSI investigator. Therefore it provides the most definitive record of the senators’ negotiations with the Red Shirt/UDD leadership on May 18th 2010.

Of course, on the very next day, May 19th 2010, the Thai Army, operating under the instruction of the Abhisit regime’s orders, conducted an operation at the Wat Pathum temple which led to the deaths of six more unarmed Thai civilians.

A copy of the memo is provided below and an English translation follows.



Memo on key points and results of the negotiation between representatives of the senate and the UDD leadership.

Day: May 18, 2010
Time: 18.30-20-15
At Ratchaprasong Intersection

The senate met [held before the senators met with the UDD leadership] with the aim to find a solution to the national crisis which stemmed from the UDD protest. The chairman and first deputy chairman of the senate held discussions with pro non-violence senate group and agreed to send three representatives to meet with UDD leaderships at Ratchaprasong Intersection at 19.00 in order to hear the [negotiation] conditions and present them to the government. The senate members [of this group] preliminarily agreed that both sides must establish a ceasefire first. This proposal was put to the Prime Minister [Abhisit] at 13.30 when the chairman of the senate called and informed him. The PM didn’t oppose the proposals and asked the leader of the senate to ask the senate’s representatives to ask three questions [of the UDD leadership].

1.Can the oil truck be move from Rama IV Road?
2.Can the government be allowed to rescue the injured, children and those who want to return home?
3. What does it mean for both side to stop? Does it mean stop shooting, stop confronting or what?

At 18.30, five senate representatives, assigned by the chairman of the senate - General Lertrat Ratanavanich, Pol Lt-Gen Yutthana Thaipakdi, Wicharn Sirichai-Ekawat, Singchai Tuengthog and Narumon Siriwat - traveled to Ratchaprasong Intersection to negotiate with the UDD leadership, to ask and find out the answers for three questions on behalf of PM, to hear the negotiation conditions, to find solution for the national crisis and to them present it to PM and also to inform them that the senate believed both side should halt the confrontation and call an immediate ceasefire.

Here were the key details of the meeting between the representatives of the senate and the UDD leadership;

1.UDD leadership were not opposed to the government’s demand to move the oil truck because they didn't know who put it in the middle of the road anyway and they are happy to have the government rescue the injured in Wat Prathum.

2. UDD leadership agreed and were happy to follow the proposals to help reduce the confrontation and clashes on all sides. They proposed that the govt should withdraw the troops from the demonstration site while negotiaion was on (the govt should proceed before 12PM on May 19th, 2010 if possible).

3.UDD leadership was happy and ready to unconditionally enter into the negotiation process held by the senate  with the government

4. If the negotiation was held the UDD leadership would send 2-3 of its representatives to negotiate with the government and were confident in their representatives’ decision and the UDD’s own unity.

5.If the negotiation was held, the senate members ( Pol Lt-Gen Yutthana Thaipakdi and other senate representatives who attended this meeting) would be prepared to ensure 2-3 UDD representatives’ safety and guaranteed they would not be arrested while negotiating with the government. A car would be provided.

6. When the negotiation ended and all sides were happy the UDD leadership was still concerned about the crowd dispersal process because they had to ensure the protesters understood the situation and would be calm enough before going home otherwise there may be a problem in that the protesters may not accept the negotiation result that the UDD leaderships had agreed upon - this process would likely take a bit of time.

Furthermore, one of the UDD leadership arrived at meeting (at around 19.40) and informed everyone that “tomorrow at 5AM. the army will crackdown on the protesters”. The senate representatives then expressed that in their opinion that if that was to happen, it might be the government’s tactic to just create a form of negotiation leverage. The government might intend to proceed with a further crackdown because the PM had already acknowledged and was already aware that the representative of the senate were taking part in negotiations. Also everyone hoped that if the [senate/UDD] negotiations that night reached a clear conclusion and led to a further negotiation [between the government & the UDD] the next morning with the senate as the mediator, then they would inform the Prime Minister immediately and this might help stop the government’s protest dispersal operation on the next day [19th May].

What can be read is “[unknown signatory] witness” and  “Police Colonel [unknown signatory] investigate, record.” The document is then dated “Nov 7, 2011”. The document appears to be signed by these persons to confirm that the memo is a verified piece of evidence to be presented after that date.]

Forensic Crime Report Relating To Deaths At Wat Patum, May 19th 2010

This is a summary translation of pages 14 and 15 of a forensic report numbered 838/2553 that was produced by the Crime Scene Investigation Department of Central Institute of Forensic Science relating to the killing of 6 persons at the Wat Pathum temple in central Bangkok on the 19th May 2010. We are unsure of the exact date this report was issued as we’ve only been able to obtain pages 4 to 15 of the entire report. However judging from the signed date, it must’ve be completed sometime between May 19th and October 23rd 2010.

At present we are only publishing the final two pages of the report as these hold the key conclusions of the report. Furthermore the English translation at this point will only be of the essential elements of that conclusion.

We will be publishing pages 4 to 13 at a later date - these pages offer a thorough and very technical examination of the crime scene at Wat Pathum.

The summary English translation below the documents relates to the specific subtopics contained within the report’s conclusion and is a summary. 


From the report's conclusion it is self-evident the victims were unarmed. It also appears that all the bullet-fire originated from the elevated position on the BTS tracks outside Wat Patum. This position was held by the Thai Army and no forensic evidence is offered in the pages of the report we currently hold that that position came under fire from the direction of Wat Patum.


Subtopic 10.1 No evidence of explosive material, drugs or use of fire arms was found on the bodies on any of the six victims

Subtopic 10.2, In summary this subtopic concludes that one of the victims Mr. Rop Suksathut, was shot and killed from a bullet that was fired from above and which traversed downwards through his body.

Subtopics 10.3, 10.4, 10.6, 10.7 conclude that four other victims Mr. Attachai Chumchan, Ms. Kamonkade Akkahad, Mr. Sukan Sriraksa and Mr. Akradet Khankaew all died as a result of being shot in the back.

Subtopic 10.5 concludes that Mr. Mongkol Khemthong was shot and killed from a bullet that was fired from above and which traversed downwards through his body.

Subtopic 10.10 concludes that the bullet marks on the road barrier in front of Wat Patum and within the temple itself indicate that the firing trajectory of the bullets originated from the elevated BTS rail tracks in front of the Wat Pathum.
